01About This Statement

This Statement describes how Bopperty Ltd ("Bopperty", "we", "us", "our") approaches equality in the design and operation of bopperty.ie and related services.

Bopperty operates in a manner consistent with the Equal Status Acts 2000-2018, which prohibit discrimination in the provision of goods, services, and accommodation on nine general protected grounds (gender, civil status, family status, sexual orientation, religion, age, disability, race, and membership of the Traveller community) and, in the accommodation context, on a tenth protected ground: housing assistance (the housing-assistance ground covers persons in receipt of rent supplement, the Housing Assistance Payment, or other social welfare payment provided in connection with accommodation).

Bopperty's user-facing service is primarily concerned with equality obligations under the Equal Status Acts. Bopperty also recognises the protected grounds reflected in the Employment Equality Acts 1998-2015 where relevant to its own operations.

This Statement should be read with the Terms of Use and Privacy Policy.

02Bopperty's Equality Commitments

Bopperty makes the following commitments in the design and operation of its service.

2.1 Areas Are Not Presented as Suitable or Unsuitable on Protected Grounds

Bopperty does not present any area, neighbourhood, town, county, or location as suitable or unsuitable for individuals on the basis of any protected ground under the Equal Status Acts 2000-2018, including the housing-assistance ground.

Area reports describe area-level context, market context, and process context. They do not assess or recommend areas for any particular person or household based on protected characteristics. The same standard applies to sold-prices pages and area comparisons: figures are presented for the areas concerned and are never an assessment of suitability for any person or group.

2.2 No Special-Category or Protected-Ground Profiling

Bopperty's reports, content hubs, and readiness check tools are not designed to infer, target, profile, or make decisions about individuals based on special-category personal data within the meaning of GDPR Article 9 or on the protected grounds under the Equal Status Acts 2000-2018.

Demographic information surfaced in reports is presented at area level only. Bopperty does not request special-category or protected-ground information for reports, readiness tools, or introduction routing, and does not use information a person volunteers in a message or request for profiling, selection, or routing. Bopperty excludes sensitive census dimensions from its data sources at ingestion, does not select, combine, or present variables for the purpose of inferring protected characteristics, and reviews the variables its reports include, individually and in combination, to reduce the risk of any operating as a proxy for a protected ground.

2.3 Readiness Check Tools Do Not Collect Protected-Ground Data

Bopperty's readiness check tools run in the user's browser: answers about a user's situation as a buyer, renter, or seller (such as buyer type, renting arrangement, property type, transaction stage, and previous progress) are used to show the user their results. Unless you choose to save a result, they are not transmitted to or stored by Bopperty. They do not collect or ask about protected-ground characteristics under the Equal Status Acts 2000-2018 (Section 1 of this Statement), are not designed to infer them, and Bopperty does not use readiness-check answers to classify users by them.

2.4 Names and Sensitive Categories in Reports

Bopperty seeks to minimise the display of personal names in reports. Reports surface organisations, registered service providers operating under trading names, and named public amenities and public-sector entities. They do not surface natural persons by name, including individual residents, owners, occupiers, or tenants, or persons providing regulated services from private homes. This reduces the risk of information being used to profile, target, or discriminate against individuals.

2.5 Local Agent Introduction Service

Bopperty's local agent introduction service at /local-experts transmits a user's request — whether about selling or letting — to a PSRA-licensed property services provider operating in the user's area and licensed for the relevant service. Bopperty does not:

  • route requests to providers on the basis of any protected ground attributed to the user;
  • request protected-ground information for routing, or use information a person volunteers in a message or request for profiling, selection, or routing;
  • present some areas or providers as more or less appropriate for users on the basis of protected grounds.

Receiving property services providers are independently subject to the Equal Status Acts 2000-2018 in their dealings with the user, including in respect of the housing-assistance ground. Bopperty does not control how receiving providers conduct themselves after an introduction. If Bopperty becomes aware of credible equality-related concerns involving a receiving provider's handling of Bopperty introductions, Bopperty may review that provider's continued participation in the introduction service.

2.6 Listing Content

Where Bopperty publishes property listings, the following standards apply to listing content.

The Equal Status Acts 2000-2018 prohibit publishing or displaying an advertisement that indicates an intention to discriminate, or that might reasonably be understood as indicating such an intention, on any protected ground listed in Section 1 of this Statement, including the housing-assistance ground. Wording that excludes or deters people on a protected ground breaches these standards whether it is explicit (for example, "no rent allowance" or "HAP not accepted") or indirect (for example, wording that a property would "suit" only a particular category of person).

Publishing agents are contractually required to comply with these standards. Bopperty does not knowingly publish listing content that breaches them, and where breaching content is identified or notified, Bopperty removes it or requires its amendment. Concerns about listing content can be raised through /corrections.

03Prohibited Uses

Bopperty's Terms of Use prohibit the use of Bopperty reports, sold-prices pages, area comparisons, content hubs, listing content, or readiness check results to discriminate, screen, exclude, target, or make decisions about any person on the basis of any protected ground under equality law, including the protected grounds under the Equal Status Acts 2000-2018 (which include housing assistance in the accommodation context) and the protected grounds reflected in the Employment Equality Acts 1998-2015.

This prohibition applies to all users, including consumers, agents, lenders, insurers, developers, public-sector users, journalists, researchers, and any other person or organisation accessing Bopperty.

04Reasonable Accommodation

Bopperty seeks to make its service accessible to users with disabilities and to those who use assistive technologies. Where you encounter an accessibility barrier in using Bopperty, including in completing a readiness check, generating a report, submitting a correction request, or contacting Bopperty, please use the contact form at /contact or write to legal@bopperty.ie. Bopperty will do all that is reasonable to accommodate the needs of a person with a disability, including by providing special treatment or facilities where without them it would be impossible or unduly difficult to avail of the service, subject to the nominal-cost and other limits under the Equal Status Acts. Accessibility requests and equality complaints are never subject to acceptance of the Terms of Use.

05Complaints

If you believe that you have been treated by Bopperty in a manner inconsistent with this Statement or with the Equal Status Acts 2000-2018, you can use the contact form at /contact or write to legal@bopperty.ie. We will acknowledge your complaint and respond as soon as reasonably practicable. Making a complaint is never subject to acceptance of the Terms of Use.

Contacting Bopperty does not affect your statutory rights. You also have the right to make a complaint to the Workplace Relations Commission, which has jurisdiction over complaints under the Equal Status Acts 2000-2018.

Equal Status complaints are subject to statutory procedures and time limits. In many cases, before referring a complaint to the Workplace Relations Commission, a complainant must first notify the service provider in writing of the nature of the allegation and of their intention to seek redress (the "ES.1 notification"), generally within two months of the alleged incident. The time limit for referring a complaint to the Workplace Relations Commission is generally six months from the alleged incident, with limited scope for extension. Users should consult the Workplace Relations Commission's current guidance for the procedures and time limits that apply to their circumstances.

06Changes to This Statement

Bopperty may update this Statement if its approach to equality, its product features, or applicable equality law changes.

The updated version will be published on bopperty.ie with a new effective date.
